The Polish Ministry of Finance announced they were postponing the mandatory KSeF e-invoicing implementation, at least, until 2025
On January 19th, Polish Ministry of Finance announced through a press conference broadcast live that the mandatory implementation of the KSeF e-invoicing system was being postponed. Even though, companies can still optionally use the system. We will reflect on the consequences of this decision.
Why has the KSeF been postponed?
The Polish Ministry of Finance cited concerns that there was a substantial risk that KSeF might not efficiently handle a large volume of invoices, and that the proper testing hadn’t been done. The potential consequence of implementing KSeF in its current form could be a scenario where businesses find themselves unable to issue invoices, thereby impeding the receipt of payments from customers.
The most important thing to keep in mind is that many companies have already implemented KSeF in its optional period and it is working with the actual specifications. The postponement, however, would give more time to the companies that haven’t started with the preparations for the mandatory period, to do so .
When will KSeF come into force?
We do not know yet the new mandatory date for the KSeF implementation. It will depend on a few steps planned by the Polish government. Firstly, the Polish Ministry of Finance asked for an external audit and as announced, the tender announcement was published on January 19. It allows for the submission of offers until January 30. They expect to sign the contract with the selected auditor until February 28 and the audit to be performed within 30 business days of signing it. This means that, probably somewhere in the middle of April, we can expect directional information about the scale of possible problems with the KSeF system, the expected time of their removal and, as a result, the expected mandatory implementation date.
The Polish Ministry of Finance and Government assured that they are committed to going through with the implementation of the KSeF e-invoicing, knowing that it is highly beneficial for the country. That is precisely why they want to make sure that when the KSeF is indeed mandatory, the system will be able to handle and process all the data load in an efficient way. The KSeF postponement could mean a bit of an extra time for the companies that have not yet started planning on implementing the solution. However, this shouldn’t be a showstopper for the ones that did start the implementation or already have it in place. The system can be used as until now, on an optional basis.
